Terms of Service

Please read these Terms of Service ("Terms") carefully before using the SleepOwl mobile application (the "App") operated by SleepOwl ("we", "us", or "our"). By downloading or using the App, you agree to be bound by these Terms. If you disagree with any part, do not use the App.

1. Eligibility

You must be at least 13 years of age to use SleepOwl. By using the App you represent that you meet this requirement. If you are under 18, you confirm that you have your parent or guardian's permission to use the App.

2. License to Use the App

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to download and use SleepOwl on a device you own or control, solely for your personal, non-commercial purposes.

You may not:

  • Copy, modify, or distribute the App or any part of it
  • Reverse-engineer, decompile, or disassemble the App
  • Rent, lease, or sublicense the App to any third party
  • Use the App for any unlawful purpose
  • Attempt to gain unauthorised access to any part of our systems

3. Subscriptions & Purchases

SleepOwl offers optional premium features through auto-renewing subscriptions managed by the Apple App Store. By subscribing you agree to the following:

  • Payment will be charged to your Apple ID account at confirmation of purchase.
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.
  • You can manage and cancel subscriptions in your Apple ID Account Settings after purchase.
  • No refunds are provided for the unused portion of a subscription period, except where required by applicable law.
  • Free trial periods, if offered, will convert to a paid subscription at the end of the trial unless cancelled beforehand.

4. User Content

You may create content within the App, such as journal entries and pet names ("User Content"). You retain ownership of your User Content. By creating it, you grant us a limited licence to store and process it solely to provide the App's features.

You are solely responsible for your User Content and represent that it does not violate any third-party rights or applicable laws.

5. Health Disclaimer

SleepOwl is not a medical device and does not provide medical advice. The sleep scores, readiness ratings, recovery suggestions, and all other information provided by the App are for informational and wellness purposes only and are not a substitute for professional medical advice, diagnosis, or treatment.

Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition or sleep disorder. Never disregard professional medical advice or delay seeking it because of something you have read or seen in the App.

6. Apple HealthKit

If you enable Apple HealthKit integration, you acknowledge that SleepOwl will read sleep and activity data from HealthKit in accordance with our Privacy Policy. You can revoke this access at any time via your iPhone's Settings.

7. Intellectual Property

The App and all its content — including but not limited to the SleepOwl name, logo, owl character artwork, animations, sleep algorithms, and software code — are the exclusive property of SleepOwl and are protected by copyright, trademark, and other intellectual property laws.

Nothing in these Terms transfers any intellectual property rights to you.

8. Prohibited Conduct

You agree not to:

  • Use the App in any way that violates applicable laws or regulations
  • Attempt to interfere with the proper functioning of the App
  • Use automated scripts to collect information from the App
  • Impersonate any person or entity
  • Engage in any conduct that restricts or inhibits any other user's enjoyment of the App

9. Disclaimers

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SLEEPOWL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify and hold harmless SleepOwl and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of your use of the App or violation of these Terms.

12. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and dispute resolution) will do so.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, by in-app notification. Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
